Circle.love includes all individuals authorized to act on its behalf. Throughout this document, we use the terms “we”, “us”, and “our” to refer to circle.love.

By accessing this Website, you agree to be bound by these Terms, all applicable laws, and regulations, and agree that you are responsible for compliance with any applicable local laws. The materials contained in this Website are protected by applicable copyright and trademark law.

Anyone may read the content posted within the Website. Any person at least 13 years old is eligible to participate in the network. We highly discourage people from posting personal information such as phone numbers, addresses, email, or other information which may make your location easily discoverable by others.

As a condition of your use of the open public network, you agree that circle.love shall have no responsibility or liability for any damage or loss you may incur as a result of sharing personal information or other content with others.

We make an effort to review content, but we do not undertake to review all material before it is posted on the Website and cannot ensure prompt removal of objectionable material after it has been posted. Accordingly, we assume no liability for any action or inaction regarding transmissions, communications or content provided by any user or third party. We have no liability or responsibility to anyone for performance or nonperformance of the activities described in this paragraph.

While circle.love may exercise its authority to enforce these Terms, including disallowing access to the Website to the extent feasible, we take no responsibility for policing user conduct or exercising editorial control over content posted. We expect users to honor the code of conduct set forth in these Terms, to participate in circle.love in good faith, and to abide by their own mature judgment.

Parental Responsibility. If you, as a parent or guardian, choose to involve any child under the age of 18 on this website, please be aware that you are responsible for the safety and security of your child, as well as remaining vigilant to what your child may read on the site. While we monitor posts, we cannot guarantee that we will catch and exclude offensive content posted by others.

This Website is not targeted toward children under the age of 13. We do not knowingly collect any Personal Information from children under the age of 13 without parental consent. If you are under the age of 13, please do not submit any Personal Information through the Website.

If you have reason to believe that a child under the age of 13 has provided Personal Information to us through the Website, without verifiable parental consent, please contact us to request that we delete that child’s Personal Information. Consistent with the Children’s Online Privacy Protection Act https://www.ecfr.gov/current/title-16/chapter-I/subchapter-C/part-312, we will promptly use commercially reasonable efforts to delete such information from our databases.

We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Policy by instructing their children never to provide Personal Information through the Website and Services without their permission.

• vulgar, violent, sexual, or obscene language and/or images. Circle.love may be accessed by people of all ages (although we do not actively target childrend under 13 years old), and all content must be appropriate for all ages.

• abusive language, name-calling, harassment, and any other personal attacks are completely opposite to the values and purpose of circle.love. BOTTOM LINE: Please be kind and respectful to others.

• advertising, commercial, or affiliate links. Absolutely No Solicitation or Advertising. Under no circumstances should you contact another member or post any content asking for money or personal assistance of any sort, offering products or services, or making any solicitation whatsoever, whether commercial or non-commercial. You may not advertise or publicize your business, goods, or services, even if the reference is subtle and does not include an explicit solicitation.

• copyrighted material that doesn’t belong to you.

• dogmatic religious or political comments

• blogging of current events, etc.

• any personal information you may happen to learn about someone. Please respect the privacy of others.

• efforts to make romantic connections. Circle.love is not a dating app.

• anything that may be likely to deceive any person.

• giberish. You may not post unintelligible, nonsensical writing to fulfil the minimum input-field character requirements.

• Remove or refuse to post any User Content that violates our Terms, at our sole discretion.

• Take any action with respect to any User Content that we deem necessary or appropriate in our sole discretion, if we believe that such User Content violates the Terms of Use, including the Content Standards, infringes any intellectual property right or other right, threatens the personal safety of users of the Website and the public or could create liability for circle.love.

• Disclose User identities when required to do so by applicable law, including in response to a law enforcement request supported by a valid court order.

• Terminate your access to all or part of the Website or Web App for violation of the Terms of Use.

You waive and hold harmless circle.love and it’s authorized representatives from any claims resulting from any action taken by circle.love during or as a result of its investigations and from any actions taken as a consequence of investigations by either circle.love or law enforcement authorities.

If you become aware of any content that may violate these guidelines, please promptly report the issue and we will look into it as quickly as possible.

By creating a new Story Entry and entering your information into the Website, you hereby accept the following additional use terms.

1. You grant us the use of your current location (at the time you made the entry) along with the IP address of your device, and/or other geolocational means. We use this information internally to know where our users are coming from. We will not share your location data or IP address with any third parties.

2. You grant the use and storage of your email address as a unique personal identifier for your Story Entry and/or account, and additionally as a means to contact you regarding any related actions. This includes promotional use of email and/or email newsletter. We do not sell your email. You may unsubscribe from new-entry email notifications, or other email messages at any time. You will also be able to request deletion of your account, in accordance with GDPR and our privacy policy.

3. We may showcase any of your Story Entries on our Website, within social media, or in any other medium. Your email address will never be publicly displayed. Your full name will never be fully displayed. We will only display the first name and first initial of your last name if you did not choose to be anonymous at the time you created a story entry.

We use a Google Maps/Places API to provide auto-complete (autofill) suggestions for the “City of Interaction” and “Specific Place” fields within the “add a new entry” portion of our Web App. Personally Identifiable information is not transmitted to Google. Users of the Web App are bound by Google’s Terms of Service. As part of Google’s API requirements for us, we must provide you with a link to their Terms of Service. Once you publish a new Story Entry within our Web App, you grant us a non-exclusive, worldwide, transferable and sublicensable right to use, copy, modify, distribute, publish, and process your publicly available Story Entry and any other related non-personally identifiable information, without any further consent, notice and/or compensation to you. You also grant other users of the Website a non-exclusive, worldwide, non-transferable and non-sublicensable right to share your Story Entry on other social media websites for their personal, non-commercial use only.

You may share your Story Entries or any Circle Card story results page through any third party social media site for your personal, non commercial use only.

For individual users, we intend to keep the core circle.love functionality for viewing entries, tracking entries, and posting new Story Entries free of charge, indefinitely. We also intend to keep the service running forever and ever, but “forever and ever” is a long time. In the unfortunate event that circle.love ceases operations, we will do our best to keep all core infrastructure functioning for a period of at least 5 years from the last date that a Circle Card was assigned to an individual or organization. The minimum 5-year period is not withstanding financial insolvency, natural disasters, war, or any other circumstances beyond our reasonable control.

Circle.love is a work in progress, and we will update these Terms of Use from time to time at our sole discretion. Your continued use of the Website following the publishing of revised Terms of Use means that you accept and agree to the changes.

You acknowledge that you have read this Policy and agree to all its terms and conditions. By accessing and using the Website and submitting your Personal Information you agree to be bound by this Policy.

You agree that these Terms of Use and your use of this Website shall be governed in all respects by the laws of the State of Colorado. Any dispute relating to the Terms and your use of this Website shall be resolved solely in the state or federal courts located in Colorado. You consent and submit to the personal jurisdiction of such courts for the purposes of any such dispute, controversy or claim and agree to waive trial by jury in any such dispute. If any provision of the Terms is held to be unenforceable, such provision will be reformed only to the extent necessary to make it enforceable.
